•  June 30, 2010 – The Pinelands Commission asks the Township by letter if required stormwater infiltration swales were installed.
•  July 28, 2010.   In a letter to Pinelands Commission Director of Regulatory Programs Charles Horner, BVT Engineer Scheidegg stated that “the municipality did, in fact, install the six (6) foot wide stormwater infiltration swales adjacent to the proposed walkways, as referenced in your June 30, 2010 letter.” He continued, “It was decided by the municipality that ... these swales would need to be removed.”

•  At the October 28, 2013 Township Meeting Committeeman Chiarello stated that existing railroad siding violations were attributed to a jurisdictional simple mix-up – the Township mistakenly assumed that NJ Transit was responsible for siding construction permits.
•  According to the lease agreement signed by then-mayor Chiarello, "All permits and licenses required...must be obtained in
order for Lessee to lawfully operate its business at the Demised Premises" (page 2).
• According to the lease agreement signed by then-mayor Chiarello, "The Lessee shall comply with all governmental laws, regulations and rules with respect to the use, maintenance and operation and occupancy of the Demised Premises" (page 12).
• According to the lease agreement signed by then-mayor Chiarello, "The Lessee shall maintain and keep at its sole cost the Demised
Premises and all facilities thereon in compliance with all federal, state and local environmental laws, rules and regulations" (page
